Wavio Beta Terms of Service

1. About these Terms
These Terms govern your participation in the controlled Wavio beta. Wavio is operated by PREKAS AS, organisation number 938 307 385, at Onsøyveien 68, 1614 Fredrikstad, Norway. PREKAS AS became Wavio's contracting provider effective 21 August 2026. You can contact Wavio at support@prekas.app.
By creating an account or accepting these Terms, you agree to them and acknowledge the Wavio Privacy Policy. If you do not agree, do not use Wavio.
2. Beta scope
The beta is a limited, pre-release service for individually invited adults in Norway/EEA. Features may be incomplete, change, contain defects, be suspended or be withdrawn. Wavio may limit tester numbers, features or access to protect users, investigate problems or operate the test responsibly.
The beta is not a promise that Wavio will launch publicly or retain every feature or item of beta data indefinitely. Any planned reset or material loss of user data will be communicated where reasonably practicable, but this does not reduce Wavio's privacy or legal obligations.
3. Eligibility and accounts
You must be at least 18 years old and legally able to agree to these Terms. You must provide accurate account information, keep your credentials secure and promptly tell Wavio if you suspect unauthorised access.
The 18+ confirmation is a self-declaration unless Wavio explicitly states otherwise. Wavio does not generally verify identity, boating competence, licences or vessel ownership.
Invitations are personal to the intended tester. Do not sell, publish or misuse an invitation or access token.
4. What Wavio is—and is not
Wavio is a social service intended to help boaters discover and communicate with other users. It is not a navigation, weather, tide, collision-avoidance, emergency, rescue or safety-of-life service.
Locations, distances, place names, profiles and availability may be inaccurate, delayed or outdated. You remain responsible for navigation, seamanship, regulatory compliance, your vessel and your decision to communicate with or meet another person.
5. Check-ins and visibility
Check-ins are voluntary location snapshots, not continuous live tracking. Before checking in, review the selected audience and duration. Information shown to an authorised recipient may be copied or captured outside Wavio and cannot always be recalled.
Checkout or expiry is intended to stop future access through Wavio, subject to the verified beta implementation and information already seen or independently retained by another person. Do not use check-ins for emergency coordination or assume another user is monitoring them.
6. Acceptable use
You must not:
- harass, threaten, stalk, discriminate against or intimidate another person;
- impersonate a person, vessel or organisation;
- disclose another person's private information or location without permission;
- use Wavio for fraud, scams, spam, unlawful solicitation or other illegal activity;
- upload malicious material or attempt to bypass security, access controls, rate limits or moderation;
- scrape, automate or reverse engineer the service except where applicable law expressly permits it;
- use Wavio while actively navigating or in a way that distracts from safe vessel operation; or
- submit false or abusive reports.
The Community Guidelines and Safety Guidelines form part of the rules for participating in the beta.
7. User content
You retain ownership of content you submit. You give Wavio a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically adapt and display that content only as reasonably necessary to provide, secure, moderate and improve the beta features you use.
This licence lasts while the content is needed for those purposes, subject to account deletion, recipient-held copies, approved safety/legal retention and technical backup cycles described in the Privacy Policy. It does not authorise Wavio to build the proposed permanent place-name dataset from historical check-ins or labels; that future purpose remains disabled and would require separate terms and user information.
You must have the rights needed to submit your content. Do not upload content that is unlawful, infringes another person's rights or exposes private information without permission.
8. Moderation and safety actions
Wavio may investigate reports and take proportionate action including content restriction, warnings, feature limits, temporary suspension or account removal. Where appropriate and safe, Wavio may explain an action and provide a route to ask for review.
Wavio may preserve limited information where reasonably necessary for user safety, service security, legal obligations or legal claims. Moderation is not continuous, and reports are not an emergency channel. Contact local emergency services if there is immediate danger.
9. Third-party services
Wavio relies on third-party services for functions such as authentication, hosting, storage, notifications, maps, place-name resolution, diagnostics, email and TestFlight distribution. Their availability and processing may be subject to their own terms and notices. Wavio remains responsible for its own selection and use of processors where data-protection law applies.
10. Privacy and communications
The Wavio Privacy Policy explains how personal information is processed. Service, security, legal and account communications are part of operating the beta. Optional Product Updates are separate and may be declined or withdrawn.
11. Account closure and suspension
You may request account deletion through the available in-app control or by contacting support. Some limited information may remain where another participant retains their own conversation, a short backup cycle applies, or an approved safety/legal reason requires restricted retention.
Wavio may close an account after 12 months without qualifying user activity. Where the verified contact address remains available, Wavio intends to give 30 days' notice and reminders with 7 days and 24 hours remaining. Signing in, qualifying use or confirming that you want to keep the account cancels the scheduled deletion. Closure uses the same verified deletion process as a user-requested deletion, subject only to separately justified restricted evidence and provider backup cycles described in the Privacy Policy.
Wavio may suspend or terminate access for serious or repeated rule violations, security risk, legal necessity, discontinued beta operation or material harm to other users. Mandatory consumer and data-protection rights remain unaffected.
12. Availability and responsibility
The beta is provided on an “as available” basis. Wavio does not guarantee uninterrupted or error-free operation. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights.
To the extent permitted by law, Wavio is not responsible for losses caused by reliance on Wavio as a navigation or emergency service, unsafe conduct, another user's independent actions, or failures outside Wavio's reasonable control. This clause does not excuse Wavio from responsibility imposed by applicable law.
13. Changes
Wavio may update the beta and these Terms. Material changes will be communicated appropriately, and renewed acceptance will be requested where required. If you do not accept a material change, you may stop using Wavio and delete your account.
14. Governing law and disputes
These Terms are governed by Norwegian law. This does not remove mandatory protections or courts available to you under applicable consumer law. Please contact support first so Wavio has an opportunity to address a concern.
